TiVo Pares Losses....
Shares of TiVo Inc. (TIVO) rose 4.8% to $8.53 after the company reported that its fourth-quarter loss narrowed to 6 cents a share from 20 cents a share in the prior year, on better-than-anticipated sales of its standard digital video recorders.
Analysts polled by FactSet Research were expecting a loss of 11 cents a share.
The Alviso, Calif., digital recording technology company's service and technology revenue rose to $58.1 million from $57 million. For the quarter ending in April, TiVo expects to post a net loss of $1 million to $3 million on service and technology revenue of $53 million to $55 million.
Analysts polled by FactSet Research were expecting a loss of 11 cents a share.

Coldwater Creek Tumbles....
Shares of Coldwater Creek Inc. (CWTR) dropped to $4.37 after the company released disappointing first-quarter guidance. The company expects to report a first-quarter loss of 14 cents to 17 cents a share, below analysts' average estimate of a per-share loss of 4 cents.
The company also reported a fourth-quarter net loss of 19 cents a share compared with a net income of 17 cents a share a year earlier. Revenue totaled $345.5 million, decreasing from $366.6 million a year ago, the Sandpoint, Idaho apparel retailer said.
Analysts had forecast a net loss of 19 cents a share.

Harris Corp Raises Guidance..
Shares of Harris Corp. (HRS) rose 4.2% to $49.48 after the company said it expects fiscal 2009 earnings of $4 to $4.10 a share on revenue of $5.7 billion to $5.8 billion, driven by growth across all operating segments as a result of demand for its information-technology products and services.
Analysts had expected, according to a poll by Thomson Financial, earnings of $3.95 a share on $5.71 billion in revenue.
The Melbourne, Fla., communications equipment said it expects to finish fiscal 2008 with a substantial backlog, which is expected to drive double-digit revenue growth in RF Communications in fiscal 2009. Thornburg Crushed After Hours....
Shares of Thornburg Mortgage Inc. (TMA) plunged 44% to $1.92 in after-hours trading after the home-mortgage lender late Wednesday disclosed that its failure to meet a $28 million margin call caused a series of cross-defaults. Thornburg also said JPMorgan Chase Bank N.A., which made the original margin call, will "exercise its rights."
In Wednesday's disclosure, Thornburg didn't specify those rights, but in a previous filing with the Securities and Exchange Commission the company said that the lender has the "right to liquidate pledged collateral." Thornburg said it was loaned $320 million under reverse repurchase agreements made with JPMorgan.
The notice of default from JPMorgan triggered cross-defaults "under all of the Company's other reverse repurchase agreements and its secured loan agreements," the company said in Wednesday's filing. Thornburg offered no description of the amounts involved in the cross-defaults, but said its "obligations under those agreements are material."

PetsMart Profit Margin Falls...
PetSmart Inc. (PETM), which is hurting from soft consumer spending, posted a 2% drop in fiscal fourth-quarter net income as its profit margin fell and said it would slow capital spending as it tries to improve performance at its stores.

Markets End Up After Digesting Ambac News. The markets finished the day up, but that was not before it tested the previous day's lows. For much of the day, most of the attention went to Ambac (ABK, -19.8%), which announced plans to raised $1.5 billion through sales of common shares and equity units. After the announcement, markets seemed disappointed with the news. Investors were looking for a true bailout that would solidify the company's balance sheet and extinguish concerns that Ambac would lose its AAA rating. Though S&P and Moody's did say they would probably confirm the bond insurer's AAA rating, the let down from the announcement pushed the markets down in the middle of the day. But like yesterday, the bottom fishers grabbed control in the afternoon and pushed the major indices back into the green to end the day.
Oil Rallies Off Inventory Decline. Crude spiked to a new record high of $104.95, before closing at $104.45. The jump was caused by OPEC's announcement that it will leave productions levels unchanged and an unexpected decline in inventories.
ISM Services Data Gives Market Hope. Before the bell the ADP Employment Report showed an unexpected decline in payrolls. Markets mostly shrugged off the figure and will pay much closer to Friday's Job's Report. The Institute for Supply Management services index data was better than expected and provided a much needed positive piece of economic data; markets were higher immediately after the announcement. Factory orders were also released, and were in-line with forecasts.

The Fed Beige Book survey showed economic growth has slowed, with 8 of the 12 Fed regional banks noticing a "weakening in the pace of business activity."
Goldman Sachs (GS, +0.7%) CEO Lloyd Blankfein believes the credit-market contraction is at least half way over.
Big Lots (BIG, +22.2%) jumped after increasing its 2008 profits forecasts.

Yahoo in Talks with Time Warner..
The latest on Yahoo (YHOO) has it in talks with Time Warner (TWX) to take over its AOL unit, in exchange for which TWX would receive a sizeable minority stake in Yahoo. The combined company could save $1B annually. Oh, and Yahoo is still talking to News Corp. (NWS) to take over MySpace etc. for a stake in Yahoo.
With all these complex negotiations, it now seems likely Yahoo will push off a March 14 deadline by when Microsoft (MSFT) must make a push to take over the board, in order to get greater clarity on its defense stance. Many doubt a YHOO/AOL merger will float.

Apple Has No Plans for Buyback or Dividend...
Apple says at its annual shareholder meeting that it has no plans for a stock buyback or dividend. Apple also said it plans to sell the iPhone in Asia this year, targeting India and China.
Costco Reports In-Line Earnings...
Costco Wholesale Corp. (COST) posted a 31% increase in fiscal second-quarter net income on strong international growth and continued consumer flight toward discount retailers.
For the period ended Feb. 17, net income was $327.9 million, or 74 cents a share, compared with $249.5 million, or 54 cents a share, a year earlier.
Last year's second quarter included $53.4 million in charges.
The wholesale-club giant's revenue increased 12% to $17 billion as same-store sales rose 7%.
Chief Financial Officer Richard Galanti said in December that a Wall Street forecast of 74 cents a share for the quarter "sounds good," saying the retailer had "gotten off to a good start" in the period.
The latest mean estimates of analysts polled by Thomson Financial were for earnings of 74 cents a share on revenue of $16.9 billion.

Financial Rollercoaster Continues. The markets bounced back after strong selling in the first half of the session. Citigroup (C, -4.3%) was under pressure early after the head of Dubai International Capital said the bank needs more funds and Merrill Lynch (MER, +2.5%) lowered its earnings forecast for Citi. Shares of the mega bank hit a nine-year low before Citigroup responded to the news by saying it is comfortable with its capital levels and would not seek new funds. The markets rallied hard after Citi came out with the release and The Financial Times reported bond insurer Ambac (ABK, +7.2%) is close to an agreement to receive a capital infusion . The deal could announce the deal as early as Wednesday. Though there was a lot of other news, this market showed today that the financial headlines truly spark rallies and sell-offs.
Intel Decreases Profitability Forecast. Intel (INTC, +0.05%) lowered its gross profit-margin forecast for Q1, citing lower flash memory prices. The company now sees margins coming in between 53%-55%, down from 55%-57%.
Housing Still Troubled, Bernanke Wants Banks To Do More. Fed Chairman Ben Bernanke caused a sell-off early in the market when he said foreclosures in the troubled U.S. housing market were likely to continue. He suggested banks write down the principal amount on mortgage loans for home owners who are at risk of defaulting. "Principal reductions that restore some equity for the homeowner may be a relatively more effective means of avoiding delinquency and foreclosure," he explained.

US Stocks Recover....
U.S. stocks recover from their lows as investors grow hopeful that a rescue package could be crafted for No. 2 bond insurer Ambac Financial. And technology stocks got a boost after Cisco Systems CEO John Chambers says he is "even more comfortable" with networking giant's revenue forecasts. Nasdaq turns positive, and the Dow trades down about 76 points.
Technical Alert: Dow nears January lows....
The Dow is currently down 200 points to 12,059.
On January 22 and 23, the Dow closed right at the 12,000 level. A close under 12000 would be very negative for the market.
The S&P is currently at 1310. That is exactly where it closed on January 22 and 23.

The Bearish Victory.....

The disparity between expectations and data continues. Those with a bearish bent argue that there is already a recession, it will be terrible, it is not priced into the market, earnings estimates must move much lower, and there will be a general calamity on the scale of the 70's stagflation or even the Great Depression. Wow!
When stocks move lower, it seems to prove the point. This is most interesting and worth some thought.
Anyone who claims to provide a market edge, almost by definition, must find occasions when the market is wrong and the analyst has a superior viewpoint. The most bearish economic pundits now get to claim victory -- even if the economy never enters a recession!
It is not necessary to be right on the facts to be right on the market. As the market moves lower, there is a building sentiment that it "must test the January lows." This advice is usually offered in a deep and stern voice. If enough people believe it, it happens. It is seen as proof of the economic forecasts.
We are now a few points away from those lows in the S&P 500 and even closer in the Nasdaq.

Staples Down After Cutting 2008 Guidance
Shares of Staples Inc. (SPLS) fell 3.6% to $21.69 after the office-supplies retailer posted a drop in fiscal fourth-quarter net income and cut it 2008 guidance as it expects a "challenging" economic climate to continue.
The company reported fourth-quarter net income of $333.2 million, or 47 cents a share, compared with $336.5 million, or 46 cents a share a year earlier. The per-share earnings figure is higher because Staples' shares count fell 3.2%.
Revenue rose 0.7% to $5.32 billion. The latest mean per-share earnings estimate of analysts polled by Thomson Financial was 47 cents on revenue of $5.37 billion.
The company now expects a percentage gain in 2008 per-share earnings in the high-single digits on sales up in the mid-single digits. Analysts had projected per-share earnings growth of 11% to $1.42 on a 7% sales increase to $19.41 billion.

Citi Down as Merrill Cuts Estimates...
Shares of Citigroup Inc. (C) fell 2.8% to $22.45 before the opening bell Tuesday after Merrill Lynch cut its 2008 earnings estimates for the banking giant and forecast another very large writedown of Citi's subprime-related exposures.
Citing "continued deterioration in U.S. residential and commercial mortgage markets, corporate dept markets and key investment-banking categories," Merrill reduced first-quarter estimates to a loss of $1.66 a share, from its previous forecast for profit of 55 cents. Full-year 2008 earnings were cut to 24 cents a shares from $2.74 a share.
"We remain concerned about loss provision potential, the direction of long-term strategy, and weak markets for the Capital Markets businesses," Merrill Lynch said in a note to clients.
Citing "continued deterioration in U.S. residential and commercial mortgage markets, corporate dept markets and key investment-banking categories," Merrill reduced first-quarter estimates to a loss of $1.66 a share, from its previous forecast for profit of 55 cents. Full-year 2008 earnings were cut to 24 cents a shares from $2.74 a share.

Intel Lowers Outlook...
Intel Corp. (INTC). The Santa Clara, Calif.-based chip maker said late Monday it is lowering its first-quarter gross margin forecast to 54%, plus or minus a point, from its previous forecast of 56%, plus or minus a couple of points, due to lower-than-expected prices for NAND flash memory chips. The company said all other expectations are consistent with the first-quarter outlook the company provided in January.

Flat Day With Less Than Stellar Data. A late day rally left the markets mostly flat, but the S&P was able to eek out a gain for the first time in a week. The biggest piece of data released was the Institute for Supply Management's factory index, which fell to 48.3. The number represented a contraction, but was slightly better than expected. The Commerce Department also released data showing construction spending dropped by 1.7%, more than estimated by economists. Both numbers served as reminders that a recession may be coming if we are already not in one.
Diebold Rejects Takeover Bid. Diebold (DBD, +61.0%) announced that it has rejected United Technology's (UTX, -1.6%) $2.64 billion bid, saying the $40/share offer undervalued the company. Diebold has seen its stock price drop recently because the SEC is investigating its revenue recognition policies.
Fannie and Freddie Overhaul Appraisal Process. Fannie Mae (FNM, -4.4%) and Freddie Mac (FRE, -5.8%) agreed to only buy mortgages from lenders that used independent home appraisers. The deal was pushed by New York Attorney General Andrew Cuomo, and a new oversight group will be created to make sure the new standards are upheld. The rules should prevent inflated appraisals, which distort the value of mortgage-backed securities whose values are based on the homes.

Thornburg Getting Crushed...
Thornburg Mortgage (TMA) getting slammed, after company reported it's been hit with another wave of margin calls, worth about $270M, and is having trouble meeting them, seeing as it just met $300M worth of calls in February. "To date, we have not met the substantial majority of the most recent margins calls," company says in SEC filing.
TMA says it's working to meet the calls by either selling portfolio securities or raising debt or equity capital. Margin calls have been triggered by declines in the value of securities backed by Alt-A mortgage loans, company says. TMA down 54% at $4.12 on heavy volume.

End of an Era for Televisions....
Sony Corp. (SNE). The Japanese electronics giant today said it will end production of cathode ray tube (CRT) televisions by the end of the month, four decades after they were launched, as consumers switch to flat-screen TVs.
Sony ended production of CRTs in Japan in 2004, but continued to produce CRT TVs under the Trinitron brand at plants in Singapore and Malaysia to meet limited demand in Latin America and parts of Asia.

Chip Sales Top Targets...
January global chip sales gained 0.03% Y/Y, beating expectations. Excluding highly-competitive memory chips, semi sales were up 8.1% Y/Y. PC and mobile handset shipments were in-line with expectations, which forecast 12% and 12--15% sales growth in 2008 respectively. "

Intel (INTC) is launching one of its trademark "branding campaigns" to market two new microchips. Now co-named Atom, the Silverthorne is targeted at MIDs (pocket-sized internet-enabled devices), while the Diamondville is for low-end laptops.
Intel's branding moves are closely watched, because the company uses its brands together with lucrative marketing incentives to dominate the market.

Will Commercial Real Estate be Next??
The impending fall of commercial real estate will take a heavy toll on firms with exposure to commercial property loans and mortgage-backed securities, such as Bear Stearns (BSC), Citigroup (C), JPMorgan (JPM), Lehman Brothers (LEH), Merrill Lynch (MER) and Morgan Stanley (MS). Goldman Sachs analyst William Tanona thin ks the above firms will write down $7.2B in Q1, and projects commercial real estate values will slide 21-26% over the next two years.
Microsoft Increasing Online Software Offerings...
Microsoft (MSFT) will announce plans to offer online software services that will handle email, calendars, contacts and video conferencing for small-to-medium-size companies for a per-user fee. MSFT will start testing its offerings today for free with select businesses, after which it will begin charging fees. How much? Only time will tell.
No doubt this was spurred by the success around the Netsuite (N) IPO late last year. That stock ran from IPO price at $22 up to $45 and back down to $21. Not good news for Netsuite, UNLESS Microsoft decides to buy them out....

United Technologies Bids for Diebold...
United Technologies (UTX) made an unsolicited $2.63B cash bid for developer Diebold (DBD). The $40/share offer is well below Diebold's 52-week high of $54.50, but a 66% premium to its Friday close of $24.12/share, UTC says the bid is "compelling." Besides ATM machines, Diebold develops security systems and computer hardware that would help UTC's fledgling fire-and-security business grow revenue from a current $5.8B to $10B+.
The move is the latest in a string of unsolicited bids as buyers look to capitalize on deflated share prices.

The Nikkei fell 4.49% to its lowest since Jan. 23, the Hang Seng was off 3.07%, and the U.S. dollar fell to 102.72 yen -- its lowest since January 2005. Investors continue to fret a potential U.S. recession, and are gearing up for yet another Fed rate cut.

Weak Finish To a Weak a Month. The markets drifted lower the whole session, with 97% of the S&P 500 finishing with losses. AIG (AIG, -6.6%) sparked the sell-off late Thursday after announcing it lost $5.29 billion in its fiscal fourth quarter as a result of massive writedowns, and said it would not buyback any of its shares for the "foreseeable future." Stocks fell further after CNBC reported the Ambac (ABK, -5.6%) bailout had hit a significant snag. Rating agencies want the banks involved to inject more money than originally proposed. The deal is still not dead, but it was only fair that the market fall on the news after it rallied on the announcement of the deal late l ast Friday. For the month, the S&P 500 fell 3.5%, the Dow finished 3.0% lower, and the Nasdaq dropped 5.0%.
Mixed Economic Data. The Personal Consumption Expenditure indicator increased 0.4% while income rose 0.3%, both figures coming in slightly higher than expected. Core PCE was right in-line. Though this was good news, the markets moved little after it was released. The Chicago Purchasing Managers Index was announced just after the opening bell and disappointed investors, posting a reading of 44.5, well below the 49.5 expected and representing a contraction in manufacturing in the region.
Northrop wins Massive Government Contract Boeing Gets Snubbed. The Air Force announced it will use Northrop Grumman Corp. (NOC, -1.7% day; +5.3% A.H.) and EADS (an Airbus unit) to build new airborne fuel tankers, in a deal worth at least $35 billion. Additional needs such as maintenance and additional parts could add another $60 billion to the deal, making it one of the largest defense contracts ever. Most experts were expecting Boeing (BA, -2.4% day; -5.6% A.H.) to win the deal. Boeing is now expected to file a protest with the Government Accountability Office; the government did not say why Boeing was not chosen.

The Gap (GPS, +3.7%) was up after reporting a 21% increase in net income. Warren Buffet released his popular annual letter to shareholders Friday, noting "the party is over" for insurance companies and lenders should be admonished for fueling the housing bubble.

Boeing is now expected to file a protest with the Government Accountability Office; the government did not say why Boeing was not chosen.

Berkshire Hathaway 4Q Net Slides...
Berkshire Hathaway Inc. (BRKA BRKB) posted an 18% drop in fourth-quarter net income on lower investment gains and a drop in insurance underwriting fees, and Chairman Warren Buffett warned that the insurance business is likely to get tougher in 2008.
"That party is over," the billionaire investor wrote in his annual letter to shareholders. "It's a certainty that insurance-industry profit margins, including ours, will fall significantly in 2008."
The investment holding company reported net income of $2.95 billion, or $1,904 a Class A share, compared with $3.58 billion, or $2,323 a Class A share, a year earlier.
Analysts surveyed by Thomson Financial had expected the Omaha, Neb., company to post earnings of $1,606 a share.

Sears Lowers Bid For Restoration Hardware...
Late Thursday Sears (SHLD) revised its buyout bid for Restoration Hardware (RSTO) $4.55/share from a previous $6.75, and offered reverse break-up fee that is $5M greater than the break-up fee Restoration set in its negotiations with private-equity firm Catterton Partners. Sears offered $6.75/share in December after Restoration agreed to be acquired by Catterton for $6.70/share in November. Catterton later dropped its bid to $4.50/share. Sears apparently likes to one-up Catterton by increments of 5.

In a SEC filing, Take-Two Interactive Software (TTWO) disclosed it has received additional interest since Electronic Arts (ERTS) made public its $2B bid for the company Sunday. It has not, however, received a written offer nor entered "substantive discussions" with any suitors.
Viacom CEO Philippe Dauman said yesterday he's not considering a bid for Take-Two.

Deere to Buy Into Chinese Machinery Company...
Deere & Co. (DE) Friday said it would buy a 50%stake of Xuzhou Xuwa Excavator Machinery Co. for an undisclosed amount. Xuzhou, a Chinese manufacturer of construction equipment, is a subsidiary ofXuzhou Bohui Science and Technology Development Co. Deere said it was seeking government approval in China for the transaction.
Shares of Deere, a Moline, Ill.-based manufacturer of agricultural andforestry machinery, closed Thursday at $86.97.

GDP and Initial Job Claims Disappoints. The markets began the day lower off worse than expected economic data and never recovered. Before the bell, the preliminary GDP reading was released, coming in at 0.6%, slightly less than economists' expectations. The figure matched the initial estimates from last month. Additionally, initial job claims increased to 373,000 which was above forecasts. Combined with the data from the last couple days, things are beginning to look bleak. "We have absolutely no momentum going into the first quarter,'' said Josh Shapiro, chief U.S. at Maria Fiorini Ramirez Inc. "Things are looking pretty grim for the economy. If we're not in a recession already, we're very close."
Bernanke Speaks, Market Drops. Fed Chairman Ben Bernanke appeared before the Senate Finance Committee today and yet again caused a sell-off. Bernanke, while answering questions, said he thought the current economic environment was more challenging than the 2001 recession and believed oil would remain high. The markets noticeably sold off when he said some small U.S. banks may fail, though he said he believed larger banks would be able to survive.

Prominent London Hedge Fund Liquidates Fund
Peloton Partners, a large London-based hedge fund, is liquidating one of its funds in the latest casualty of the credit crisis. The firm is in the process of alerting investors that is winding down its Peloton ABS fund.
In my opinion this is why last years high fliers are getting crushed of late. This is the 2nd large hedge fund in the last week to fold. They sell their assets with no regard for price. Exactly what we have seen since January 1.

Cap Lifted For Home Loan Providers. The markets took off early in the session on news that the Office of Federal Housing Enterprise Oversight decided to remove Fannie Mae's (FNM, +1.1%) and Freddie Mac's (FRE, -0.5%) $1.5 trillion mortgage portfolio cap. The cap was created after the two companies found $11.3 billion in accounting errors in 2006. The lenders should now be better able to provide financing for the U.S.'s troubled housing market.
Earlier in the morning, Fannie Mae reported a greater than expected $3.6 billion loss and shares of the company hit a 12-year low, but news of the regulator's decision turned the stock around. Later in the day, the markets sold off, as investors pocketed profits. It seems many do not want to leave profits on the table when a bad piece of data or headline could erase any gains.
Bernanke Signals Further Rate Cuts. Fed Chairman Ben Bernanke spoke in front of the Senate Banking Committee Wednesday and provided some relief to investors. Despite rising inflation pressures, he indicated the Fed would continue easing rates as economic downside risks remained the key focus.
Economic Data Misses Estimates. The Commerce Department reported durable goods fell 5.3%, which was slightly worse than expected. Meanwhile, new homes sales came in at 588,000, missing the 600,000 expected and representing a 13-year low. Both pieces of data were not horrible, but showed signs of a deteriorating economy.

Costco Down as Goldman Cuts Rating on Co....
Shares of Costco Wholesale Corp. (COST) is down 2.4% to $64.86 after Goldman Sachs cut its rating on the warehouse retailer to neutral from buy.
In a note to clients, Goldman Sachs analyst Adrianne Shapira wrote that "with current relative valuation well above historic averages and limited remaining catalysts on the horizon, we view current risk/reward less compelling."
The stock appeared to be breaking out yesterday, but this downgrade should cause it to pull back. It has key support at $62.50.

Netflix Up After Boosting 1Q Outlook...
Shares of Netflix Inc. (NFLX) are up 6.9% to $31 before the opening bell Wednesday after the online DVD rental service boosted its first-quarter earnings outlook.
The Los Gatos, Calif., company said it now sees first-quarter earnings of 15 cents to 22 cents a share on revenue of $324 million to $328 million. The company had previously forecast first quarter earnings of 13 cents to 21 cents a share on revenue of $323 million to $328 million.
Analysts expect, on average, earnings of 20 cents a share on revenue of $325 million.
In addition, Netflix sees first-quarter ending subscribers of 8.16 million to 8.26 million, up from a prior view of 7.85 million to 8.05 million ending subscribers.

US January Durable Goods Orders Drop 5.3%..
Orders for durable goods fall 5.3% to $212.80 billion and a barometer of capital spending by businesses slumps, an indication the sluggish economy might be restraining companies. Economists expected a smaller 4% decrease in durable goods orders.

Eyes will be trained on Washington D.C. on Wednesday as Bernanke begins his two days of Congressional testimony, starting at 10 a.m. Eastern.

J&J, Amgen Fall on New Study...
Anemia drugs Aranesp and Procrit sold by Amgen (AMGN) and Johnson & Johnson (JNJ) raise the risk of death among cancer patients by about 10%, a new study of previous trials found. Amgen played down the study, saying the risks are already in the drugs' labels.
The FDA will convene in March to decide whether to impose further restrictions on the drugs, commonly used to treat chemotherapy-induced anemia. Shares of Amgen and J&J were down 3.2% and 1.15% in Europe.

The U.S. dollar hit record lows against the euro after weak consumer confidence and surprise inflation raised the odds of further interest-rate cuts.
Consumer Confidence fell to 75 vs. 82 consensus, down from 87.3 -- its lowest in nearly 15 years. Both core (+0.4%) and headline (+1%) wholesale inflation surprised to the upside; 12-month PPI of 7.4% is at its highest in over 25 years.

EU Hits Mocrosoft With $1.3B Fine...
The EU fined Microsoft (MSFT) a record $1.3 billion for overcharging developers for interoperability information needed to develop Windows-compatible software. Microsoft noted the fines related to past issues that have been resolved.
Microsoft has dropped licensee royalty demands from 2.98%-3.87% to 0.5-0.7% and later to a flat fee of $14,000 for interoperability info and a worldwide patent license for 0.4%. There was speculation a penalty could go as high as $2.2B.

Toll Bros. Misses, But Sees Glimmers of Hope...
Number-one U.S. luxury homebuilder Toll Brothers (TOL) posted a $0.61/share loss, exceeding the -$0.44 expected by analysts. The loss included a $245M writedown, net of which Toll earned $0.35/share. Net contracts signed fell 50% to $375M; backlog fell 42% to $2.4B.
CEO Robert Toll was again critical of the media's relentless 'drumbeat' recession talk, which he said dampens consumers' moods and keeps them from buying. Toll said selling remains weak, but that it sees a few "glimmers of hope."

IBM Announcements Push Markets Higher. Some days you take what you can get and do not ask why. Despite a deluge of bad news this morning (see below), the markets traded higher as investors focused on IBM's (IBM, +3.9%) announcement of a new $15 billion buyback plan and increased outlook. After the news came out in during mid-morning trading, stocks took off. IBM increased its EPS estimate for 2008 by $0.05, and said it has seen strength in foreign markets and received a boost from acquisitions.
Weak Data From All Directions. The Labor Department reported the Producer's Price Index came in at 1.0%, while core-PPI increased by 0.4%. Both readings were well ahead of expectations and put the Fed in a tough position of fending off inflation while trying to stimulate growth. The Conference Board reported consumer confidence fell to a 5-year low, and the S&P/Case-Shiller home price index showed that prices plummeted 8.9% in the fourth quarter of 2007, compared to the year before. With signs of a weak economy and increasing inflation, fears of stagflation jumped.
Target Sees Tough First Half of 2008. Target (TGT, +3.1%) reported earnings before the bell that beat expectations by a penny, but said it expects to see "a challenging economic climate at least through the first half of the year." The company has seen shoppers buying more necessities and less higher margin items such as clothing.

Frontier Misses but Stock Rises...
Frontier Oil Corp.'s (FTO) fourth-quarter net income fell to $43.4 million, or 41 cents a share, from $52.4 million, or 47 cents a share, a year earlier. A Thomson Financial survey of analysts, on average, projected earnings of 46 cents a share for the quarter.
The Houston refiner's fourth-quarter results included a hedging loss of $31.5 million, or 30 cents a share, compared with the gain of $6.9 million, or 6 cents a share, a year ago. Revenue rose to $1.32 billion from $1.09 billion a year ago.

IBM Plans $15B Buyback...Boosts Guidance...
International Business Machines Corp. (IBM) said Tuesday its board authorized the repurchase of $15 billion in shares, which could boost its earnings for 2008. The new plan is in addition to the $400 million left on a previous buyback plan. IBM said it plans to make about $12 billion in stock repurchases in 2008. The company said expected buyback activity could add about 5 cents a share to 2008 earnings, and now expects a profit of at least $8.25 a share for the year. Analysts surveyed by FactSet Research expect 2008 earnings of $8.21 a share.

Sirius / XM Update...
Sirius (SIRI) remains optimistic it will hear favorable information in the near future regarding long-awaited merger with XM (XMSR), SIRI CEO Mel Karmazin says on conference call. He won't provide 2008 guidance until there's regulatory clarity, which "hopefully will be very shortly." CEO says he hasn't had additional contact with Justice Dept. "We wait by our telephone, but we really have not heard anything from them. It has been more radio silence than anything else," Karmazin says. Reiterates SIRI's costs would increase if merger isn't approved.

Google Advertising Slows...
The Street is surprised at Google's (GOOG) sharply lower paid-click-through rates and slower search growth in January, based on comScore report. Percentage of GOOG's paid-advertiser clicks dropped to 10.4% in January from 12.4% in December, reaching the lowest rate since comScore began tracking in July 2006. BMO Capital believes data just reflects GOOG culling "accidental clicks" to improve search quality.
Bear Stearns calls it a "concerning data point" that jibes with what Internet marketers have been saying: "that they were not seeing a high volume of clicks from consumers possibly due to the economic slowdown."
GOOG stock is down 6.9% to $453, lowest since last April.

Futures Reverse on PPI Number....
US Producer Prices Up 1%, Core Gains 0.4%
U.S. wholesale prices surge more than anticipated in January and core inflation also climbs above expectations, according to more data revealing price pressures amid the economic slowdown. In the 12 months ending in January, prices climbed 7.4% on an unadjusted basis.
Stock futures reversed corse on the news, they are now considerably lower.
U.S. wholesale prices surge more than anticipated in January and core inflation also climbs above expectations, according to more data revealing price pressures amid the economic slowdown. In the 12 months ending in January, prices climbed 7.4% on an unadjusted basis.
Stock futures reversed corse on the news, they are now considerably lower.
Nordstrom Beats Buts Sees Tough 2008...
Nordstrom (JWN) posted Q4 EPS of $0.92, beating consensus estimates of $0.88. Revenue fell 4.4% to $2.51B, just short of the $2.53B consensus. Looking ahead, Nordstrom sees Q1 EPS of $0.49-0.54 (vs. $0.59 consensus) and full-year EPS of $2.75-2.90 (vs. $2.98 consensus). Same-store sales will be flat to -2%, it said. "Certainly, it's a difficult environment. ... The higher-end consumer is slowing spending a bit," analyst Dan Geiman said.
Foster Wheeler Misses....
Foster Wheeler Ltd. (FWLT). The Clinton, NJ-based engineering and construct company today said adjusted fourth-quarter income dropped to $80.6 million, or 56 cents a share, compared with $85.9 million, or 60 cents a share, a year-ago.
Revenue for the quarter rose to $1.47 billion from last year's $1.19 billion.
The company was anticipated to earn 76 cents a share. The stock is down 7 points to $72.50 premarket.

Sony and Sharp in LCD Panel Venture...
Sony (SNE) and Sharp say they have agreed to jointly produce LCD panels for televisions using a state-of-the-art Sharp plant currently under construction in western Japan. Venture to be established in April 2009, production by March 2010.

January Foreclosure Filings Surge 57%...
Foreclosure filings for January jump 57% to 233,001 from a year earlier and 8% from December. RealtyTrac CEO says on-month slowdown may signal homeowner aid is working. Nevada has the highest foreclosure rate, trailed by California.
MBIA Eliminates Dividend...
Standard & Poor's rewards bond insurer for raising $2.6 billion in capital by affirming the company's triple-A financial-strength rating while keeping its outlook "negative." MBIA also eliminates its dividend to preserve $174 million.
Home Depot Net Falls 27%, Issues Weak Outlook...
Home Depot (HD) posts 4Q earnings of $671 million, or 40¢ a share, due in part to higher operating costs. Revenue increases 1.5% to $17.66 billion, but fall 4.7%, excluding an extra week during the quarter. Th retailer forecasts fiscal-year earnings from continuing operations to slump 19%-24% on a total sales decline of 4%-5%.
